Opinion of Hon. E. H. Sharp, K.C., Acting Attorney-

General of Hongkong.

I am of opinion, upon the evidence adduced at

the trial of Li Kwai Fan, and upon the Crown Solicitor's note of further statements made by Kong Ngau Ying, Chan Wan and Tam Tseung that the Crown would be justified in charging Tung Cheung with the murder, as one of the gang which was present at and actually

perpetrated the deed.

The statements of the same witnesses and of

Tam Tai concerning Yeung Tsing Kai (the Captain of the Chinese Gunboat "Kin Yui"), and the statements of the Kongs and of Mr. May concerning Ng Lo Sam (the police agent in Hongkong), consti- tute a strong case against these two persons of conspiring to murder together with Tung Cheung, Li Kwai Fan (the condemned man)

and Chan Lam Tsai, who has been executed by the Chinese Authori-

ties on suspicion of communicating in the matter with the Hongkong

Police.

There is more evidence to support the charge

of conspiracy than that of being accessory before the fact. For

example, Kong Kung Ki, Kong Kai and Mr. May only speak of the un-

successful attempt which was made by Ma Wong Loi's gang under the

direction of Ng Lo Sam in November, 1900, and can prove nothing with regard to the successful attempt by Li Kwai Fan's gang. The discrepancy between the statements of Kong Ngau Ying and Chan Wan

as to whether Yeung Tsing Kai was in Hongkong or Canton at the time

of the murder I do not regard as very important. He seems to have

been frequently here in connection with the plot, and witnesses

speaking more than two years after the events might confuse the

point
